Right of Withdrawal

As a consumer (Section 13 of the German Civil Code, BGB) you have the following statutory right of withdrawal for contracts with Motion ToGo UG (haftungsbeschränkt). Businesses have no statutory right of withdrawal; they can, however, cancel their order free of charge until production starts (see the terms).

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period will expire after fourteen days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (Motion ToGo UG (haftungsbeschränkt), Drebkauer Straße 5d, 03226 Vetschau/Spreewald) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory.

You can also electronically fill in and submit the model withdrawal form or any other unequivocal statement on our website (https://motiontogo.de/en/widerruf). If you use this option, we will communicate to you an acknowledgement of receipt of such a withdrawal on a durable medium (e.g. by email) without delay.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated us your withdrawal from this contract, in comparison with the full coverage of the contract.

Withdrawing online

The quickest way to withdraw is the “Withdraw from contract” button. It is in the footer of every page of our website and leads to the form further down this page – no login needed, always available, even after production has started.

1. Enter your name, your order number and the email address to which we should send the confirmation. No reason is required.
2. Check your details and click “Confirm withdrawal”.
3. We immediately send you an acknowledgement of receipt by email – with the content of your statement and the date and time of receipt.

You can of course also declare your withdrawal by letter or email.

Early start and expiry of the right of withdrawal

We deliver within a few business days. We therefore begin production before the withdrawal period ends – but only because you expressly request it. To do so, you tick a separate box before ordering. It is not pre-ticked and not combined with accepting the terms:

“I expressly request that Motion ToGo begin the service before the withdrawal period expires. I am aware that my right of withdrawal ends once the contract has been fully performed.”

For private customers this declaration is a prerequisite for ordering via our website. We store it with wording, text version and time and confirm it in the order confirmation email. Your right of withdrawal continues until the service has been performed in full:

• The right of withdrawal expires as soon as we have fully performed the service (Section 356 (4) BGB). It is fully performed when the finished video files are made available on your order page.
• If you withdraw before that, you owe compensation for the part of the service provided up to your withdrawal under Section 357a (2) BGB (see “Effects of withdrawal”). We will tell you the amount and how it was calculated, and refund the rest.

Independently of the right of withdrawal, you can cancel your order free of charge at any time until production starts and receive the full amount back.
